sell are void where prohibited. Sales on this site, and any disputes arising
out of purchases, sales, or other use of this site, shall be governed,
construed, and enforced in accordance with the laws of the State of Texas,
excluding its conflict of laws provisions.

ACCEPTABLE SITE USE

This is an e-commerce shopping site and no other use is permitted.
The site may only be used for lawful purposes. Users are prohibited from
violating or attempting to violate the security of this site or using it to
obtain products not properly ordered and fully paid for. Users may not send
unsolicited email messages ("spam") to or through the site or
otherwise harass the site owners or other users. We reserve the right to refuse
to deal with any user who violates our rules.

CATALOGUES

Western Drummer does not print catalogs at this time.
Due to the current economic status, it is not wise to print catalogs when our
consumers can shop online.

PLACING ORDERS

Western Drummer only sells retail. Please feel free to place an order
online. If you need assistance via phone, we can access information for you,
but due to security information, we must ask that you place your order online
so we may capture your IP address for the order information in case of credit
card disputes.

Our system is connected with the USPS shipping system; it gives "quotes"
for weighed freight. Due to USPS's box dimensions policy, they may charge
additional freight for larger boxes. We print your shipping label according to
the weight only. If you order large items and do not want to be charged
additional by USPS, please do not use this site. Freight will be charged when
your order is weighed and shipped, if it is not charged when your order is
placed. Western Drummer ships USPS Priority Mail only.

RETURNS

PLEASE VIEW ALL PHOTOS CAREFULLY, RETURNS ARE NOT ACCEPTED. ALL SALES ARE FINAL.

PHONE ORDERS

Please feel free to place an order online. If you need assistance via phone,
we can access information for you, but due to security information, we must ask
that you place your order online so we may capture your IP address, for the
order information in case of credit card disputes.

SALES TAX

Texas residents will be charged a 6.75% sales tax.

PRICES

Prices are subject to change without notice.

BACKORDERS

Items not available at time of shipment will be backordered.
Backorders can occur from product being damaged before shipment, or due to
inventory adjustments. We will make every effort to process your order in an
expedient and efficient manner.

PICK-UPS

We are sorry, but all orders will be shipped, we do not have pick-up
availability.

SHIPPING

Orders "typically" ship out of the warehouse within 2-weeks after
they are placed. Please allow 3-4 weeks for your U.S. order to arrive and 4-6
weeks for International orders. Orders are processed in the manner they are
received. Western Drummer will send you an email when your order status changes
for shipping, backorder, etc. If you have a question as to your order status,
please log into your account and check the order details. Western Drummer is
not responsible for unaccepted, abandoned or uninsured packages.

INTERNATIONAL SHIPPING

Western Drummer prefers to U.S.P.S. for international shipments due to the
freight savings to our customers. Some international orders cannot be insured,
due to the ship method (Small Flat Rate boxes and Envelopes), this is not the
choice of Western Drummer, but of U.S.P.S. International packages will be
abandoned if they are not picked up or accepted by the addressee. It is not
advisable for the customer to pay additional charges to ship back to the states
for abandoned packages. Western Drummer is not responsible for unaccepted,
abandoned or uninsured packages.

 

DAMAGED SHIPMENTS

Once your order leaves our facility, they become the responsibility of the
shipper. In case of loss or damage caused by the carrier, a report should be
made to that carrier. Customers must inspect the shipment upon arrival and note
any damages or shortages on the shipping papers prior to signing. They then
should call the carrier for an inspector and keep all packing materials.

CLAIMS

Customers receiving concealed damaged and/or defective items must email
photos of your damaged items to drummer@westerndrummer.com,
with an explanation of the damage within 3 calendars days of receiving the
item(s). We will file a claim with USPS for you. We DO NOT send replacement
items for shipping errors with USPS or any other designated carrier. It is out
of our hands once your item leaves our warehouse. If you would like to complain
about damaged freight, please call USPS.

REFUSED OR UNCLAIMED SHIPMENTS

Once your order leaves our facility, they become the responsibility of the
shipper. If you are not at the designated address when the package arrives, you
do not pick-up your package or you refuse the shipment, your account will only
be credit for the remaining amount less freight and a re-stocking fee. If your
package has been restocked and you would like to have it redelivered, you will
need to re-purchase the item(s), since we will credit your account for the item
return (less freight and restocking fee).

CANCELLATIONS

Orders that are canceled after they have been picked, packed and staged,
will be assessed a 15% restocking charge. If a shipment is refused, customers
will be charged the inbound and outbound freight and a 15% restocking charge.

TERMS

All accounts must prepay their orders by credit card (credit cards will be
processed at the time of shipment). We are sorry, but we do not accept checks
nor do we carry balances for any customers. Western Drummer only accepts VISA,
MASTERCARD and DISCOVER.

CREDIT CHECK

We do not run credit checks on our customers. All orders are processed via
credit card as they are shipped. We may run a pre-authorization to verify funds
on your credit card for large orders prior to pulling them.

VENUE

Sales and like transactions, including collection of amounts due,
shall be governed by the substantive law of the State of Texas. By placing an
order or accepting goods, you agree that the service of process may be made in
accordance with the rules of the courts of the State of Texas at the "bill
to" or the "ship to" addresses which you designate, or any other
address at which you have an actual office. In an action for the collection of
amounts due, we will be entitled to an award of collection costs including
reasonable attorney's fee.

 

SATISFACTION
